Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Dirt Cheap Labs ("Dirt Cheap Labs", "we", "us", or "our"), a service operated by a United States limited liability company, covering your use of dirtcheaplabs.com and any service we offer through it (the "Service"). By using the Service, placing an order, or paying, you agree to these Terms. If you do not agree, do not use the Service. "You" means the person using the Service and, if you use the Service on behalf of an organization, that organization as well. If you agree to these Terms on behalf of an organization, you confirm that you have the authority to bind it.

1. Eligibility (you must be 18 or older)

You must be at least 18 years old and a resident of the United States to use the Service. By placing an order you confirm that you are 18 or older, that the information you give us is true, and that you are ordering tests for yourself. Anyone who is tested must also be 18 or older and a United States resident. Ordering for another person is allowed only under Section 6. The Service is not for minors. We do not knowingly sell to anyone under 18.

2. What the Service is, and what it is not

Dirt Cheap Labs lets you choose lab tests (one of our flat-price panels or individual tests from our catalog), pay once, and receive a lab order form (the laboratory calls it a requisition). That order form is the thing you buy from us. You take it to a Quest Diagnostics or Labcorp location and get your blood drawn. The laboratory runs your tests and holds your results, and releases them to you directly under Section 4. Where we are able to, we also pass a copy of the report along to you as a PDF, as a convenience and not as a separate thing you have bought. Some accounts we approve in advance may place orders for other people under Section 6.

Dirt Cheap Labs does not practice medicine, does not perform laboratory testing, and is not a healthcare provider, a laboratory, or a medical group. We do not recommend or endorse any specific test. The tests are performed by an independent laboratory (Quest Diagnostics or Labcorp), and your order is authorized by an independent physician network arranged by our lab-ordering partner. We do not own or control either one, and we do not make any clinical decision about you or your care.

The Service is a way to order and pay for lab testing. It is not a doctor's visit, a diagnosis, a treatment plan, or medical advice. We do not interpret your results, tell you what they mean for you, or tell you what to do about them. We are not your doctor and using the Service does not create a doctor-patient relationship between you and Dirt Cheap Labs. See the Lab Testing Consent, which you also agree to when you order.

3. No doctor visit, and how ordering works

You do not see or speak to a doctor to use the Service. So that your tests can be ordered lawfully, your lab order is authorized through a licensed physician network arranged by our lab-ordering partner. You are not that physician's patient, they do not evaluate you, and they do not provide you care or advice. Their role is limited to authorizing the lab order so the lab can run it. No physician-patient relationship is created.

Once we issue your order form, the timing of your blood draw is yours to decide. You choose when to go to the laboratory, which location to use, and whether to go at all. We do not book your appointment, hold a slot for you, or send you reminders. Your order form stays valid for 12 months from the day we issue it. An order form left unused at the end of those 12 months means the tests are never performed, and our part of the order is still complete.

4. The role of the laboratory and our lab-ordering partner

We work with third parties to deliver the Service. The laboratory (Quest Diagnostics or Labcorp) performs the blood draw and runs the lab tests at its locations. Our lab-ordering partner provides the technology that places your lab order with the physician network and the lab and returns your results to us. When you get drawn at the laboratory, you are also subject to the laboratory's own terms and privacy practices, which are separate from ours. We do not control the laboratory's facilities, staff, scheduling, or lab operations.

The laboratory that runs your tests holds your results too. Create an account directly with Quest Diagnostics or Labcorp, whichever laboratory you used, under the same name and date of birth you gave us, and the laboratory will release your results to you directly. Getting your results is your responsibility, and the laboratory's own report is the record of what was run and what it showed.

5. State availability

The Service is available only where direct-to-consumer lab testing is permitted. Some states regulate self-ordered lab testing in ways that limit who can use the Service. We do not serve New Jersey, New York, or Rhode Island: checkout does not accept an address in those states, so an order cannot be placed here and you are not charged. If an order for one of those states is placed some other way and we cannot complete it, we cancel it and refund it in full, and the cancellation fee described in Section 8 does not apply.

6. Ordering for someone else

Most people use the Service for themselves. We also approve a limited number of accounts that may place orders for other people. These accounts are not open to the public. You get one only if we approve you in advance, and we may decline or withdraw approval at any time.

If you hold one of these accounts, everything in this section applies to you in addition to the rest of these Terms.

7. Ordering, pricing, and payment

The price shown at checkout is the price you pay for the tests you selected. Payment is processed by Stripe, our payment processor. We do not store your full card number. By placing an order you authorize us, through Stripe, to charge your payment method for the amount shown. Your order is confirmed when payment succeeds and we send your order form. We may decline or cancel an order if we cannot lawfully fulfill it (for example, a restricted state) or if we suspect fraud or misuse.

By placing an order you confirm that you own the payment method you use, or that you have the account owner's permission to use it. If you're paying for someone else's tests, the charge remains yours.

Before you pay, the checkout screen shows the exact tests you're buying and the exact amount you'll be charged. Placing the order means you have read that list and agreed to it.

If a payment dispute is raised on your order, we'll give the card issuer our records of that order, including the tests and amount you agreed to, the order form we issued, the messages we sent you, and the times your documents were opened. You agree those records are accurate and may be used for that purpose.

The name, date of birth, sex, address, and contact details on your order are the ones you enter, and we send them to the laboratory as you gave them to us. Before you pay, we show all of them back to you on a confirmation screen and ask you to check them against your government ID. There is no way to reach payment without passing that screen. If what you entered is wrong, the laboratory may turn you away at the draw, or your results may be issued under the wrong details, and sorting that out is your responsibility, not ours. Correcting details after an order is placed is not always possible, and a new order may be required. An order placed with details you entered incorrectly is not a failure to deliver on our part, and it is not a basis for a refund outside Section 8.

8. Refunds and cancellation

You can cancel and request a refund any time before you get your blood drawn at the laboratory. Your order form is valid for 12 months from the day it is issued, and an order you have not used yet can be cancelled on these same terms at any point in that window. Your order is placed with the lab the moment payment goes through, and the platform fee paid to place it is not refundable after that point. A cancellation you ask for before your draw is refunded minus that platform fee, which usually runs $20 to $50 depending on how many tests are on the order. An order we cancel because we cannot fulfill it is refunded in full, with no fee taken. Once your blood has been drawn, the order is final and cannot be refunded, because the lab work has begun. To cancel, contact us at orders@dirtcheaplabs.com with your order number before you go to the lab. Refunds are returned to your original payment method and may take several business days to appear. The cancellation right in this section applies while we are operating and able to reach the laboratory on your behalf. Section 21 says what applies once we stop.

Checkout does not accept an address in a state we do not serve, so an order from one of those states cannot be placed here and you are not charged. If an order for one of those states is placed some other way and we cannot complete it, we cancel it and refund it in full, and the platform fee above does not apply. If we can complete it, the ordinary rules in this section apply, and you may still need to get drawn in a state where testing is permitted.

If the laboratory or a collection site is unable to complete a purchased test (for example, because the specimen was insufficient or was not collected correctly, such as the wrong tube type), any recollection or redraw is arranged between you and the laboratory or collection site. We do not perform the draw and are not responsible for arranging or paying for a new draw, a new specimen, or a new order. A test reported as not performed does not entitle you to a refund once your blood has been drawn, and it is subject to the No Warranties and Limitation of Liability sections below.

9. Acceptable use

You agree to use the Service only for lawful purposes, and only for yourself unless Section 6 applies to you. You agree not to: give false information, order on behalf of someone who has not authorized it, attempt to access accounts or data that are not yours, scrape or copy the catalog or pricing, interfere with or probe the site's security, or use the Service in any way that violates applicable law. We may suspend or terminate your access if you break these rules.

10. No warranties

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that any result will be delivered within a specific time, since draw scheduling and lab turnaround are handled by the laboratory. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy of lab results, which are produced by the lab, not by us. We may also stop, suspend, or turn off the site, your account, your document links, or emails from us. An interruption or failure in our own site, links, emails, or results pages does not change what you bought, which is the order form described in Section 2, and it does not put your results out of reach, because the laboratory holds them and releases them to you directly under Section 4. Section 21 applies if we stop offering the Service altogether.

If the laboratory is unable to perform an individual test within a multi-test order after your sample is collected, that is a laboratory decision outside our control. The order is considered fulfilled, and individual unperformed markers are not separately refundable.

Your results are also held by the laboratory that performed your tests. If a result does not appear in your account or reach you by email, you are responsible for obtaining it directly from the laboratory. Keep an account with Quest Diagnostics or Labcorp, registered under the same name and date of birth you gave on your order, so you can retrieve your results there if you have any difficulty receiving them from us. The blood draw and the testing are performed by the laboratory and its collection sites. By placing an order you agree that we are not responsible for anything that goes wrong on the laboratory's side. That includes a mistake at the collection site, an error by the person drawing your blood, a specimen that is mishandled, lost, damaged, insufficient, or collected in the wrong tube, a delay in processing or reporting your results, a test the laboratory cannot perform or reports as not performed, an inaccurate or misread result, a result that differs from what you expected, the reference ranges the laboratory applies, a problem with the laboratory's own equipment or systems, its hours, scheduling, or staffing, a refusal to draw you, and the physician network's decision to authorize or decline your order. These things are outside our control, and any problem with them is between you and the laboratory. We are not responsible for any delay in, or failure of, your access to results through the laboratory's own systems.

11. Limitation of liability

Dirt Cheap Labs does not perform your blood draw, run your tests, or authorize your order. Those are done by the laboratory and an independent physician network. To the fullest extent allowed by law, Dirt Cheap Labs is not liable for any harm caused by the acts or omissions of the laboratory, the physician network, or any other third party.

To the fullest extent allowed by law, Dirt Cheap Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of profits, or personal injury, arising out of or related to your use of the Service, your lab results, the interpretation or misinterpretation of those results, or any action or inaction you take based on them. If Dirt Cheap Labs is found liable for anything, that liability is limited to the amount you paid for the order that gave rise to the claim, and in no case will it include consequential or punitive damages. Some states do not allow some of these limits, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dirt Cheap Labs from any claim, loss, or expense (including reasonable attorney fees) arising from your use or misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party. If Section 6 applies to you, this also covers any claim brought by, or relating to, a person you placed an order for.

13. No insurance billing

You pay for the Service yourself, or the account that placed the order pays for it. Charges from Dirt Cheap Labs may not be submitted for reimbursement to any insurance plan or other health care benefit program or payor, by you or by anyone you placed an order for, and we do not bill insurance.

14. Health data and HIPAA

Dirt Cheap Labs is a technology service, not a healthcare provider or a laboratory, and it may not be a "covered entity" as that term is defined under the federal HIPAA law. The laboratory and the physicians who authorize your order are subject to their own privacy obligations. How we handle your information is described in our Privacy Policy. If Section 6 applies to you and your own organization is subject to HIPAA, we are not acting as your business associate unless we have signed a separate written agreement that says so.

15. Arbitration and waiver of class actions

Please read this section carefully. It affects how disputes between you and Dirt Cheap Labs are resolved.

You and Dirt Cheap Labs agree that any dispute or claim relating to the Service or these Terms will be resolved by binding individual arbitration, not in court, except that either party may bring an individual claim in small claims court. The arbitration is handled by a neutral arbitrator and the result is final. You and Dirt Cheap Labs are each giving up the right to a trial by jury.

You and Dirt Cheap Labs agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not hear claims on a class basis.

You can opt out of this arbitration and class-action-waiver section by emailing orders@dirtcheaplabs.com within 30 days of first agreeing to these Terms, with your name and the email you used. If you opt out, this section does not apply to you.

16. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the date at the top and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.

17. Marketing and email updates

When you place an order, create an account, or enter a giveaway, you may receive occasional emails from Dirt Cheap Labs, such as product updates, new test announcements, giveaway news, and promotional offers or discounts. This includes reminders to retest and discount offers based on your order and your testing history. You can unsubscribe at any time using the link or reply instructions in any of those emails, and that choice does not affect transactional emails about your orders, results, or account.

18. Partner program

Anyone with an account gets a share code. When a friend orders for the first time with your code, the friend gets a discount on that first order and you earn account credit. Credit has no cash value, is not redeemable for cash, and can be used only toward orders on this site. We may change, pause, or end the partner program, adjust the credit rate or discount, or close a code at any time, including for abuse such as self-referral or fraud.

Credit is a promotional balance. It isn't money you have deposited with us and it isn't a debt we owe you. We may reduce, withhold, expire, or cancel any credit balance, and may decline to honor credit at checkout, at any time and for any reason, with or without notice. If the partner program ends, any unspent credit ends with it. Nothing in this section entitles you to a payment, a refund, or compensation for credit that's removed or not honored.

19. Governing law and venue

These Terms are governed by the law of the state in which Dirt Cheap Labs is organized, without regard to its conflict-of-laws rules, and by applicable United States federal law, including the Federal Arbitration Act. Any arbitration or permitted court action will be seated in that state, and you agree to that venue. Any claim must be brought within one year after it arises, to the extent the law allows.

21. If we stop offering the Service

We can stop offering the Service at any time, and we may close the site and the accounts on it. This section says what applies to an order you placed before we stopped.

Our part of your order is finished when we issue your order form. That is the thing you buy from us, Section 2 says so, and Section 3 gives it a life of 12 months from the day it is issued. An order form we issued is still a real lab order after we stop. It stays valid for the rest of those 12 months, and you can take it to the laboratory printed on it and get your draw.

Because our part is already finished, an order placed before we stopped cannot be cancelled, and it is not refundable. Once we stop, we cannot recall an order from the laboratory, so there is nothing left for us to cancel. An order for which we issued an order form is not an order we were unable to fulfill, and the full refund described in Section 8 for an order we cancel does not apply to it.

Your results are held by the laboratory, as Section 4 explains. After we stop we no longer receive results, and you obtain them from the laboratory directly, through the laboratory's own patient portal or by contacting the laboratory, using the same name and date of birth that appear on your order form.

Before you claim that an order was not delivered, you agree to use the order form we issued you, or to ask the laboratory for the results of a draw you have already had. Those are the ways to get what you paid for, and both of them stay open to you after we stop.

Us stopping is not a failure to deliver your order, and on its own it is not a basis for a refund, a payment dispute, or any other claim.

We may close accounts, including accounts approved under Section 6, and remove the documents we store for you, with or without notice. Download your order form and any results we hold before that happens. Removing our copies does not affect your order form's validity at the laboratory, and it does not affect the laboratory's own record of your results.
